Terms of Service

These Terms govern access to and use of BestBulkSMS, including SMS messaging, WhatsApp Business Platform tools, dashboards, wallets, APIs, delivery reports, integrations and related services.

Important summary

By creating an account, funding a wallet, connecting a sender, using the dashboard or sending API requests, you agree to these Terms.

Customer-controlled messaging

Customers decide recipients, content, purpose, sender identity and lawful basis for messages.

Compliance is mandatory

Spam, fraud, deception, abuse, unauthorised lists and prohibited content are not allowed.

Delivery is not guaranteed

Networks, Meta, WhatsApp, gateways, devices and compliance rules may delay or reject messages.

Wallets and APIs must be secured

Customers must protect credentials, API keys, account access and wallet operations.

Section 1

Agreement and acceptance

These Terms of Service are a binding agreement between you, the Customer, and IRISE GLOBAL TECH NETWORK, trading as BestBulkSMS. They apply when you access the website, create an account, use the SMS platform, connect WhatsApp assets, fund a wallet, use the APIs, receive support or otherwise use the Services.

If you use the Services for a company, school, organisation or client, you represent that you have authority to bind that entity. If you do not agree to these Terms, do not use the Services.

Important legal review note

These Terms should be reviewed by qualified legal counsel before final production reliance, especially for regulated sectors, financial messaging, healthcare, schools, government, cross-border messaging and high-volume campaigns.

Bulk SMS, personalised SMS, transactional SMS, sender-ID support, scheduling, routing, wallet billing and delivery reports.

WhatsApp messaging

Customer-owned WABA connection, business phone management, templates, dashboard sending, queueing, wallet fees and delivery status.

Bearer-token API access for approved SMS or WhatsApp messaging, balance checks, message status, templates and connected senders.

Wallets, transfer records, dashboards, logs, reports, support, compliance review, anti-abuse controls and account administration.

Section 2

Definitions

The following terms are used throughout these Terms. Other capitalised words may be defined where they appear.

Term Meaning
Account A BestBulkSMS customer profile, user login or organisation profile used to access the Services.
Customer The person, business, school, organisation, developer or other entity using the Services.
Recipient A person or telephone number that receives, or is intended to receive, a message sent through the Services.
Services The BestBulkSMS website, dashboards, SMS tools, WhatsApp tools, wallets, APIs, support and related messaging features.
Customer Content Recipient lists, message bodies, template variables, sender IDs, business profile data, media, files, instructions and other data submitted by a Customer.
WABA A WhatsApp Business Account connected by a Customer through Meta Embedded Signup or another supported authorised process.
Wallet A prepaid or account-balance feature used to pay service fees, messaging charges or other platform fees.
API Key A credential issued to a Customer to authenticate API requests. It must be kept secret and used only server-side.
Section 3

Eligibility and accounts

You must be able to enter a legally binding contract and must provide accurate account information. If you create an account for a business or organisation, you must be authorised to do so.

  • You are responsible for all activity under your account, including actions taken by employees, contractors, developers, agents or compromised credentials.
  • You must keep login credentials, API keys, wallet access, phone-number verification and Meta business access secure.
  • You must notify us promptly of unauthorised access, suspected compromise, leaked API keys, fraudulent wallet activity or abuse.
  • We may request additional verification, compliance information or authority evidence before enabling or continuing access to certain features.
  • We may refuse, restrict or close an account where registration information is false, incomplete, misleading, unauthorised or high risk.
Section 4

Customer responsibilities

BestBulkSMS provides messaging technology. You are responsible for the legality, accuracy and authorisation of your messages, recipients, business identity and instructions.

  1. Provide accurate registration, billing, business, sender and contact information.
  2. Use the Services only for lawful, authorised and permitted messaging purposes.
  3. Obtain, record and honour all required recipient consent, opt-in, opt-out, suppression and do-not-contact requirements.
  4. Ensure Customer Content is accurate, lawful, non-deceptive and does not infringe third-party rights.
  5. Keep account credentials, API keys, Meta business access and administrator accounts secure.
  6. Use only recipient numbers that the Customer is legally permitted to contact.
  7. Comply with telecommunications, data-protection, consumer-protection, advertising, anti-spam and sector-specific laws.
  8. Comply with applicable mobile-network, gateway, Meta, WhatsApp and payment-provider rules.
  9. Promptly investigate complaints, remove invalid contacts and stop prohibited or harmful messaging.
  10. Pay all applicable charges and maintain enough wallet balance for intended use.
Consent and lawful basis

Our ability to technically send a message does not mean the message is lawful. You must maintain a lawful basis and evidence for each recipient, message type and purpose.

Section 5

SMS services

SMS Services may include bulk SMS, transactional SMS, personalised SMS, scheduling, resend features, sender-ID support, short links, route selection, wallet debits, delivery reports, API sending and related tools.

SMS content and recipient data

You represent that recipient numbers, message content, sender IDs, personalised fields and attached or uploaded files are lawfully obtained and may be processed for the stated purpose. You must not submit unnecessary sensitive information or unsafe content.

Delivery reports

Delivery reports depend on gateways, networks, devices and destination rules. A report may be delayed, incomplete, unavailable or inaccurate due to factors outside our control.

Routing

We may select, change, suspend or replace gateways, routes, network groups or provider configurations to improve reliability, manage costs, comply with rules, prevent abuse or respond to provider availability.

Section 6

WhatsApp services

WhatsApp Services are designed so each Customer uses the Customer's own Meta Business Portfolio, WhatsApp Business Account, business phone number, business profile, display name and approved templates. You must not misrepresent your identity or use another person's business assets without authority.

Meta Embedded Signup

You may be required to complete Meta Embedded Signup, grant permissions, verify business details, register a phone number, configure payment methods with Meta where applicable and accept Meta or WhatsApp terms. BestBulkSMS is not responsible for Meta's approval decisions, restrictions or account actions.

Customer-owned WhatsApp charges

WhatsApp Business Platform charges, if billed by Meta, may be billed separately by Meta or through the payment method associated with the Customer's WABA. BestBulkSMS platform fees, service fees or wallet charges may also apply.

Connection security

You authorise BestBulkSMS to use granted permissions to manage the connected WABA, phone number, templates, profile, messages, webhooks and delivery events as required to provide the Services. You may revoke access, but revocation may interrupt sending, synchronization and reporting.

Section 7

APIs and integrations

APIs allow authorised Customers to integrate their systems with BestBulkSMS. API access may be limited, rate-limited, suspended, revoked or modified to protect the platform, prevent abuse, manage capacity or comply with law and provider rules.

  • API keys are confidential credentials and must be used only from secure server-side systems.
  • Do not place API keys in browser JavaScript, mobile apps, public repositories, screenshots, customer support messages or logs.
  • You are responsible for requests sent with your API keys, including charges, recipient lists, content and compliance.
  • Use idempotency keys, retry controls, timeout handling and message-status checks where the API documentation requires or recommends them.
  • Revoke API keys immediately if you suspect leakage, misuse or unauthorised access.
Section 8

Acceptable use

You must not use the Services for unlawful, deceptive, harmful, unauthorised or abusive messaging. Prohibited conduct includes:

  • Spam, unsolicited bulk messaging, scraping, purchased lists or messages sent without required permission.
  • Phishing, impersonation, fraud, fake prizes, scams, malware, spyware, credential harvesting or deceptive links.
  • Illegal financial schemes, Ponzi schemes, investment fraud, gambling where unlawful, or misleading loan/credit offers.
  • Hate, harassment, threats, intimidation, exploitation, blackmail or unlawful discrimination.
  • Messages that promote violence, terrorism, human trafficking, child exploitation or other serious harm.
  • Messages containing passwords, full payment-card details, private keys, access tokens or unnecessary sensitive data.
  • Content that violates telecom rules, Meta policies, WhatsApp policies, network rules or applicable law.
  • Attempts to bypass rate limits, fraud controls, wallet debits, sender verification, template review or delivery restrictions.
  • Reselling or sublicensing the Services without written permission where the account is not configured for that activity.
  • Reverse engineering, scanning, attacking, overloading, disrupting or compromising the platform or its providers.
Immediate restriction

We may immediately block messages, suspend sending, revoke API access, restrict wallets or close accounts where we reasonably believe the Services are being used for prohibited activity.

Section 9

Sender IDs and business identity

Sender IDs, business profiles, display names, WhatsApp phone numbers and other sender identities must be accurate, authorised and non-misleading.

  • You must not impersonate another person, company, school, government office, bank, telecom operator or brand.
  • You must provide proof of authority where a sender ID, business name or display name requires verification.
  • Networks, providers, Meta or WhatsApp may reject, suspend, change or require re-verification of a sender identity.
  • BestBulkSMS may refuse or remove a sender identity that appears misleading, unauthorised, risky or non-compliant.
Section 10

Templates, message content and approvals

WhatsApp templates, sender IDs and some message categories may require review by Meta, WhatsApp, networks or providers. Submission does not guarantee approval, continued availability or deliverability.

Template accuracy

Template names, categories, languages, examples, variables, buttons and content must truthfully reflect the intended use. You must not disguise marketing as utility, authentication, security or service messaging.

Content changes

A template or sender identity that was previously approved may later be rejected, paused, limited, downgraded or disabled due to complaints, policy updates, quality issues or provider decisions.

Section 11

Wallets, billing and fees

BestBulkSMS may operate prepaid wallets, separate SMS and WhatsApp balances, wallet transfers, transaction histories, taxes, payment references and billing records.

Prepaid use

Messaging features are generally prepaid. A request may be rejected, queued, reserved, cancelled or not processed where the wallet has insufficient available balance.

Separate balances

SMS wallet balances and WhatsApp wallet balances may be separate. Moving money between them may require a wallet-transfer action where available.

Estimates

Estimates are not final invoices. Final fees may depend on destination, network, segments, route, template type, provider response, retries, taxes or service fees.

Taxes and charges

Prices may include or exclude VAT, taxes, gateway fees, payment processor fees or service charges depending on the transaction and notice displayed.

Refunds

Refunds, reversals or credits are handled according to platform records, provider confirmations, payment status, fraud checks and applicable law.

Disputes

Customers must raise billing disputes promptly with transaction references, dates and supporting information.

No unauthorised charge avoidance

Attempts to bypass wallet debiting, exploit price errors, manipulate routes, duplicate credits or abuse refunds may result in suspension, reversal, recovery action and account closure.

Section 12

Delivery, availability and service limits

We work to provide reliable messaging services, but message acceptance does not guarantee final delivery, recipient reading, network acceptance or provider approval. Delivery may fail or be delayed for many reasons, including:

  • Recipient phone number is inactive, unreachable, invalid, blocked or roaming.
  • Recipient device, inbox, network, carrier, DND setting or WhatsApp setting prevents delivery.
  • Sender ID, WABA, display name, phone number, template or route is not approved or becomes restricted.
  • Gateway, carrier, Meta, WhatsApp, payment processor or hosting provider delays or rejects a request.
  • Wallet balance, risk checks, compliance controls or rate limits prevent processing.
  • The message content violates law, policy, network rules or platform acceptable-use requirements.
  • Force majeure, outages, maintenance, internet failures, cyber incidents or third-party service disruption occurs.

Services may also be unavailable during maintenance, upgrades, security responses, provider outages, infrastructure failures or events outside our reasonable control.

Section 13

Data, privacy and deletion

Use of the Services involves processing account, recipient, message, wallet, API, delivery, security and support data. The following documents form part of the service framework:

  • The Privacy Policy explains how personal data is collected, used, shared, retained and protected.
  • The Data Deletion page explains how account users, recipients and representatives can request deletion or suppression.
  • Customers remain responsible for their own lawful basis, notices, consent records and recipient requests.
  • BestBulkSMS may process Customer Content to provide, secure, bill, troubleshoot and enforce the Services.
  • BestBulkSMS may preserve records needed for security, fraud prevention, accounting, legal claims, regulatory obligations, complaint handling and suppression.
Section 14

Security and access controls

We may use access controls, session protection, CSRF protection, rate limits, abuse controls, logging, encryption, webhook signature validation, API-key restrictions and other safeguards. Customers must also maintain their own security controls.

  • Use strong passwords and secure devices.
  • Limit administrator access to authorised users.
  • Rotate credentials when staff leave or systems change.
  • Monitor message, wallet and API activity.
  • Report suspected compromise immediately.
Section 15

Suspension, restriction and termination

We may suspend, restrict, rate-limit, block, revoke, remove, disconnect or terminate access to any part of the Services where reasonably necessary. Reasons may include:

  • Suspected spam, fraud, phishing, unlawful messaging or policy abuse.
  • Invalid or misleading identity, sender ID, business profile, WABA, template or registration information.
  • Chargebacks, failed payments, negative wallet activity or unresolved billing disputes.
  • Compromised account, leaked API key, security risk or unauthorised access.
  • Excessive errors, high complaint rates, blocked content or network/provider restrictions.
  • Requests from lawful authorities, networks, Meta, WhatsApp, payment processors or other providers.
  • Violation of these Terms, the Privacy Policy, provider rules or applicable law.

Suspension or termination does not remove outstanding payment obligations, legal duties, dispute records, compliance obligations or provisions intended to survive termination.

Section 16

Third-party services and provider rules

Messaging services depend on third parties. You must comply with their rules where applicable, and their decisions may affect your ability to use BestBulkSMS.

Hosting, security and analytics tools Infrastructure, availability, anti-abuse controls, logs, monitoring, diagnostics and service improvement.

BestBulkSMS is not responsible for independent decisions, outages, pricing, approvals, restrictions or data practices of third-party services outside our direct control.

Section 17

Intellectual property

BestBulkSMS, its software, dashboards, designs, workflows, documentation, logos, service names, code, databases, reports, user interfaces and platform materials are owned by or licensed to IRISE GLOBAL TECH NETWORK, except for Customer Content and third-party materials.

You receive a limited, revocable, non-exclusive, non-transferable right to use the Services in accordance with these Terms. You may not copy, modify, reverse engineer, resell, scrape, frame or exploit the platform except as expressly permitted.

You retain rights in your Customer Content, but you grant BestBulkSMS the rights necessary to host, process, transmit, secure, troubleshoot, display, bill, report and otherwise provide the Services.

Section 18

Disclaimers

The Services are provided on an "as is" and "as available" basis to the maximum extent permitted by law. We do not promise that the Services will be uninterrupted, error-free, compatible with every system, free from provider interruption or capable of achieving a specific business result.

We do not provide legal advice, consent advice, regulatory advice, tax advice or telecommunications compliance advice. You are responsible for obtaining professional advice appropriate to your messages, recipients, industry and jurisdiction.

Section 19

Limitation of liability

To the maximum extent permitted by law, BestBulkSMS and its owners, directors, officers, employees, contractors and service providers will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, loss of profits, loss of revenue, loss of goodwill, loss of data, business interruption, message non-delivery, provider restrictions or unauthorised use of your account.

To the maximum extent permitted by law, our total aggregate liability for claims relating to the Services will not exceed the amount of platform fees you paid to BestBulkSMS for the affected Service in the three months before the event giving rise to the claim, excluding third-party passthrough charges, taxes and amounts not retained by BestBulkSMS.

Mandatory rights

Nothing in these Terms limits liability where it cannot lawfully be limited, including liability that applicable law requires to remain unrestricted.

Section 20

Indemnity

You agree to defend, indemnify and hold harmless BestBulkSMS, IRISE GLOBAL TECH NETWORK and their directors, officers, employees, contractors and service providers from claims, losses, damages, penalties, fines, costs and expenses arising from:

  • Your Customer Content, recipient lists, messages, templates, sender IDs or business identity.
  • Your breach of these Terms, provider rules, privacy duties, consent requirements or law.
  • Complaints, claims or investigations caused by messages sent under your account or API keys.
  • Unauthorised use of another person's brand, number, WABA, sender identity, personal data or intellectual property.
  • Your misuse of wallets, payments, refunds, chargebacks or platform credits.
Section 21

Changes to these Terms

  • We may update these Terms to reflect new features, laws, provider rules, pricing models, security requirements or business changes.
  • Material changes may be notified by website notice, dashboard notice, email or another reasonable method.
  • Continued use of the Services after the effective date of updated Terms means the Customer accepts the updated Terms.
  • If a Customer does not agree to updated Terms, the Customer must stop using the Services and close the account subject to outstanding obligations.
Section 22

Governing law and disputes

These Terms are governed by the laws of the Federal Republic of Nigeria, without regard to conflict-of-law rules, unless mandatory law requires otherwise.

Before commencing formal proceedings, the parties should first attempt in good faith to resolve a dispute through support escalation and management review. This does not prevent either party from seeking urgent protective, injunctive, regulatory or lawful enforcement relief where appropriate.

Courts or dispute-resolution forums with competent jurisdiction in Nigeria may hear disputes, subject to any mandatory consumer, data-protection or telecommunications rules that apply.
